Terms & Conditions
1. Definitions
Client: The individual or entity commissioning the services of Musa Landscape Architecture.
Company: Musa Landscape Architecture, owned by Ryan McMahon, located at 28 Slamannan Rd, Falkirk FK1 5LE.
Services: The garden design, consultation, and related services provided by the Company.
Contract: The agreement between the Client and the Company for the provision of Services, comprising these Terms & Conditions and any accompanying Proposal or Quotation.
2. Scope of Work
The Company shall provide Services as detailed in the Proposal or Quotation agreed upon with the Client.
Any modifications or additional services requested by the Client must be agreed upon in writing and may incur additional charges.
3. Fees and Payment
A non-refundable deposit of 20% of the total fee is required upon acceptance of the Proposal to secure the booking.
The remaining balance shall be paid in instalments as outlined in the payment schedule provided in the Proposal.
Payments are due within 7 days of the invoice date. Late payments may incur interest at a rate of 8% plus the Bank of England base rate, calculated from the invoice due date.
4. Client Responsibilities
Ensure safe and unimpeded access to the site during agreed working hours.
Obtain all necessary planning permissions, licenses, and consents required for the project.
Provide accurate information regarding site boundaries, underground services, and any other pertinent details.
5. Site Conditions
The Company is not liable for unforeseen site conditions such as hidden underground services, rocks, or contaminants not disclosed by the Client.
Any additional costs arising from such unforeseen conditions will be the responsibility of the Client.
6. Materials and Workmanship
All materials supplied by the Company remain its property until full payment is received.
The Company warrants that all materials and workmanship will be of satisfactory quality and fit for purpose.
Any defects due to faulty materials or workmanship will be rectified by the Company at no additional cost to the Client.
7. Planting and Maintenance
The Company will execute the basic requirements for the initial establishment of planting and grass areas.
Following the practical completion of the contract, the responsibility for proper maintenance of the site passes to the Client.
The Company cannot be held responsible for plant failure due to adverse weather conditions, neglect, or other factors beyond its control.
8. Cancellation and Termination
The Client may cancel the Contract within 14 days of acceptance without providing a reason, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Cancellation must be communicated in writing. If Services have commenced at the Client’s request within the cancellation period, the Client will be liable for costs incurred up to the point of cancellation.
The Company reserves the right to terminate the Contract if the Client fails to make payments as agreed or breaches any other terms of the Contract.
9. Liability
The Company holds Public Liability and Professional Indemnity Insurance.
The Company’s liability for any claim arising from the Services shall be limited to the value of the Contract.
The Company is not liable for any indirect or consequential losses incurred by the Client.
10. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of Scotland.
Any disputes arising under or in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the Scottish courts.
